1. Acceptance of Terms

These Terms of Use ("Terms") apply to the website located at www.tcure.ca (the "Site") and all associated services provided by Technocure Inc. ("Technocure," "we," "us," or "our").

BY USING THIS SITE, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THIS SITE.

2. Eligibility

You must be at least 18 years of age to use this Site or purchase our services. By using this Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using this Site on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

3. Intellectual Property

All content published on our Site is the property of Technocure Inc. and its creators. This includes, but is not limited to, images, text, logos, documents, downloadable files, designs, and any other materials that contribute to the composition of our Site.

You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our prior written consent.

Upon full payment for services rendered, intellectual property rights for deliverables created specifically for you (such as custom website designs, logos, or applications) will transfer to you as outlined in your service agreement.

4. Services

The following services are available through our Site:

  • Website design and development
  • Mobile application design and development
  • Logo design and branding
  • Search engine optimization (SEO)
  • Google Ads management
  • Digital marketing
  • Social media management
  • Content creation and copywriting
  • Website and application hosting
  • Maintenance and support
  • AI and automation consulting
  • IT support and hardware installation (Greater Montreal area)

Service titles and descriptions may vary on the Site. All information, descriptions, and images provided about our services are as accurate as possible. However, we reserve the right to modify service offerings, descriptions, and pricing at any time without prior notice.

5. Orders and Payments

Most of our services are customized, so pricing is provided on a per-project basis. You may not see direct pricing on the Site for all services.

We accept the following payment methods:

  • Credit card (Visa, Mastercard, American Express)
  • Interac e-Transfer
  • PayPal
  • Direct debit
  • Wire transfer
  • Cheque

Payment terms will be specified in your service agreement or invoice. By providing payment information, you authorize us to charge the agreed amount to your chosen payment method.

We reserve the right to modify, reject, or cancel any order at our discretion. If we cancel an order after payment has been processed, we will issue a refund for any undelivered services.

6. Subscriptions and Recurring Services

Subscription services may include website hosting, application hosting, domain name registration, maintenance, security monitoring, and ongoing support.

Manual Renewal Subscriptions: Some subscriptions do not automatically renew. For these, you will be notified before your next payment is due and must authorize payment for your subscription to continue.

Automatic Recurring Subscriptions: Some subscriptions are set up with automatic recurring billing through our payment processors (such as Stripe or other platforms). For these subscriptions:

  • Your credit card or payment method will be charged automatically on each billing date
  • You will receive a receipt for each payment
  • You authorize us to store your payment information and charge your payment method on a recurring basis until you cancel
  • If a payment fails, we may attempt to charge your payment method again or contact you to update your payment information

Cancellation: To cancel any subscription or recurring service, you must send a written request to support@tcure.ca at least 30 days before your next billing date. Cancellation requests received less than 30 days before the billing date will take effect in the following billing cycle. For automatic recurring subscriptions, your payment method will no longer be charged after your cancellation takes effect.

No refunds will be issued for partial subscription periods.

7. Refund Policy

Refund requests must be submitted in writing to support@tcure.ca within 30 days of the original payment date.

Refunds may be issued in the following circumstances:

  • Services were not delivered as agreed
  • You cancel your order within 48 hours of placing it, and no work has commenced
  • We are unable to deliver the agreed services within 30 days after receiving all required materials from you

Refunds do not apply to:

  • Domain name registrations or renewals
  • Hosting services already activated
  • Completed logo designs or digital content delivered and approved
  • Third-party licenses, subscriptions, or software purchases
  • Custom development work that has been completed and delivered
  • Services where you have approved the final deliverable

Refund amounts will be determined based on the work completed at the time of the request. Partial refunds may be issued where applicable.

8. Client Responsibilities

To ensure timely delivery of services, you agree to:

  • Provide all required materials (text, images, logos, content, business information) in a timely manner
  • Respond to requests for feedback or approval within a reasonable timeframe
  • Provide accurate and complete information
  • Ensure you have the rights to any content you provide to us

Delays caused by late delivery of materials or feedback may affect project timelines and are not grounds for refunds or cancellation.

9. Acceptable Use

When using our Site or services, you agree not to:

  • Use our services for any unlawful purpose or in violation of any applicable laws
  • Infringe upon the intellectual property rights of others
  • Upload or transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to our systems or networks
  • Use our services to send spam or unsolicited communications
  • Misrepresent your identity or affiliation
  • Interfere with the proper functioning of the Site

We reserve the right to suspend or terminate your access to our services if you violate these Terms.

10. Disclaimer of Warranties

THE SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Site will be uninterrupted, secure, or error-free
  • Any specific results will be achieved from our services
  • Search engine rankings will improve or be maintained (SEO results depend on many factors beyond our control)
  • Third-party services integrated with our deliverables will remain available or unchanged

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECHNOCURE INC. AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SITE OR OUR SERVICES.

Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid to us for the specific service giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Technocure Inc. and its directors, officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

  • Your use of our Site or services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you provide to us

13. Privacy

Your use of this Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection and use of your information as described in the Privacy Policy.

You acknowledge that Internet transmissions are never completely private or secure, and any information you send to the Site may be intercepted by others.

14. Links to Third-Party Websites

Our Site may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party website. You access third-party websites at your own risk and should review their terms and privacy policies before use.

15. Consumer Protection

Where the Quebec Consumer Protection Act or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms will not limit your legal rights and remedies under that legislation. If there is a conflict between these Terms and mandatory provisions of applicable consumer protection legislation, the mandatory provisions will apply.

16. Dispute Resolution

In the event of any dispute arising from these Terms or your use of our services, you agree to first attempt to resolve the dispute informally by contacting us at support@tcure.ca.

If the dispute cannot be resolved informally within 30 days, either party may pursue formal legal remedies. Any legal action shall be brought exclusively in the courts of the Province of Quebec, District of Montreal, and you consent to the jurisdiction of such courts.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

19. Changes to These Terms

We may update these Terms at any time to reflect changes in our practices or legal requirements. When we make changes, we will update the "Effective Date" at the top of this page and post the revised version on our Site.

It is your responsibility to review these Terms periodically. Your continued use of the Site or our services after any changes constitutes your acceptance of the updated Terms.

20. Feedback

Any feedback, suggestions, or ideas you provide to us shall be deemed non-confidential. We are free to use such feedback without restriction or compensation to you.
